Collections

 

Wessler Law Firm can assist you or your business in the collection of outstanding debt. We have handled collection cases, both consumer and commercial, for individuals and institutional lenders such as local and regional banks, for over 40 years.

 

We have also been retained by the Harrison County Board of Supervisors for the purpose of collecting delinquent personal property taxes owed to Harrison County.

 

Since being hired in 2007, our firm has been successful in recovering millions of dollars in unpaid personal property taxes owed to Harrison County Mississippi.

In most collections cases, our fee is a straight 33% contingency fee based on the amount, if any, that we collect. For example, if $100 is recovered after we file suit, our fee is $33.00, with the other $67.00 going to the client.  The client usually advances the court costs which typically run about $250.00, although it can be more if it is difficult to have the defendant served.  

 

In some cases, where recovery looks doubtful, we may charge an initial fee of approximately $300.00 to file suit and attempt to reduce the claim to judgment.  Based on our many years of experience, we can provide all clients with common sense suggestions to avoid wasting time and money in situations where collection is very unlikely.

Local Counsel Services

We have served as local counsel in many high profile bankruptcy cases in the United States Bankruptcy Court for the Southern District of Mississippi.Our office is conveniently located a few blocks from the bankruptcy court in Gulfport.  We are thoroughly familiar with the local rules and local filing procedures using electronic filing.  We have capability of making copies for trial exhibits, providing the conference room for depositions and conferences, as well as appearing and participating in cases if lead counsel is unable or would prefer not to attend a given hearing. With more than 35 years of experience in all facets of bankruptcy practice we are ready and able to fill as large or as small a role in a case as lead counsel desires.

Replevins

Under Mississippi law a suit to recover possession of personal property ( such as vehicles, mobile homes, furniture or equipment) is called a replevin suit.  We have handled hundreds of replevins for individuals and institutional lenders in at least 15 counties in South Mississippi.  Our fee for most replevins is approximately $600.00, not including the court costs which usually run about $300.00.  We have extensive experience and knowledge of the local procedures in the various counties and how to expedite obtaining a hearing date and therefore speed up recovery of the wrongfully detained property.

Foreclosures

We have handled real estate foreclosures for individuals and institutional lenders for over 30 years in many counties located in South Mississippi.  From an initial notice of intent to default through the foreclosure sale and if necessary eviction of the borrower from the property after the sale, we have years of experience.  The usual cost for the foreclosure is between $600.00 and $1200.00, not including the court costs and cost of publishing the sale notice.  Those costs normally run about $500.00.
